SMS Terms and Conditions

All Island Management and its affiliates (“We” or “Us”) are offering a mobile messaging program (the “Program”), which you agree to use and participate in subject to these SMS Marketing Terms and Conditions (the “Terms”). By opting in to or participating in any of our Programs, you accept and agree to these terms and conditions. PLEASE READ THESE TERMS CAREFULLY, AS THEY CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND US.

User Opt-In:

The Program allows users to receive SMS/MMS mobile messages or other marketing and informational communications by opting into the Program. Opt-in may occur through online or application-based enrollment forms or by texting a keyword to one of our phone numbers (such as a traditional 10-digit phone number, toll-free number, or short code). Short codes are 5- or 6-digit numbers used to exchange SMS/MMS messages.

You may be required to respond to confirm your opt-in. Regardless of the opt-in method used to join the Program, you agree that these Terms apply to your participation. By participating in the Program, you agree to receive text messages, including automated messages, at the phone number associated with your opt-in.

Consent to receive messages is not required to make any purchase from Us. While you consent to receive messages and calls sent using an autodialer, this should not be interpreted to suggest that any of Our mobile messages are sent using an Automatic Telephone Dialing System (“ATDS”). You and We agree that the system used to send messages is not an ATDS.

User Opt-Out:

If you no longer wish to participate in the Program or no longer agree to these Terms, you may opt out by replying STOP, UNSUBSCRIBE, REMOVE, CANCEL, END, QUIT, OPT OUT, or ARRET to any message from Us.

You may receive one additional message confirming your opt-out request. These opt-out methods are the only recognized means of opting out. Other methods, including sending different words or verbally asking an employee to remove you from the list, may not be recognized as valid opt-out requests.

Support Instructions:

For support regarding the Program, reply HELP to any message you receive from Us or email jason@allislandmanagement.com.

For additional opt-out support, contact our SMS platform provider SlickText at support@slicktext.com.

Cost and Frequency:

We do not charge you for messages sent through the Program. However, message and data rates may apply depending on your wireless carrier plan. The Program involves recurring messages and the frequency may vary depending on your interactions with Us.

MMS Disclosure:

The Program will attempt to send SMS messages if your mobile device does not support MMS messaging.

Disclaimer of Warranty:

The Program is offered on an “as-is” basis and may not be available in all areas at all times. Service may be affected by changes made by your wireless carrier, including product, software, or coverage changes.

We are not responsible for delays or failures in message delivery. T-Mobile is not liable for delayed or undelivered messages.

Participant Requirements:

You must own a wireless device capable of two-way messaging, use a participating wireless carrier, and maintain an active wireless service subscription with text messaging capabilities.

Not all mobile providers support the required services to participate. Please check your mobile device and carrier capabilities for compatibility.

SMS/MMS Privacy Policy:

We respect your privacy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Information you provide will only be used to transmit messages and respond to you if necessary. This may include sharing information with platform providers, phone carriers, vendors assisting with message delivery, or companies that engage Us to promote their services.

We reserve the right to disclose information when required to comply with laws, regulations, governmental requests, avoid liability, or protect our rights or property.

Information Accuracy:

When submitting information through forms or participating in the Program, you agree to provide accurate, complete, and truthful information. You agree not to use a false or misleading name or a name you are not authorized to use.

If we believe any information provided is false, incomplete, or misleading, or that you have opted into the Program for improper purposes, we reserve the right to deny access to the Program and pursue any available legal remedies.

This privacy policy applies only to the SMS Program and does not affect other privacy policies that may apply to your relationship with Us in other contexts.
